Terms of service

These terms apply to everyone who uses Spotted, whether as an organiser who uploads photos or as an attendee who receives them. By creating an account or uploading photos you agree to them. Spotted is operated by LoveIt Labs in South Africa ("we", "us").

What Spotted does

An organiser uploads the photos from an event. An attendee adds one selfie. Spotted finds the photos that show the attendee and delivers them in the form the organiser chose: branded with the event's logo and sponsors, marked with a watermark, or clean. How we handle personal information, including faces, is set out in the privacy policy, which forms part of these terms.

Organisers

• You confirm that you have the right to upload every photo you upload, including any permission the photographer's contract requires, and that you have told the people at your event that photos will be taken and made available to attendees through face matching.
• You are responsible for who you approve to join your event and for the delivery treatment you choose.
• You must not upload photos that are unlawful, that you have no right to, or that were taken where people had a reasonable expectation of privacy.
• You can delete your event at any time. Deleting it removes its photos and the matches made from them.

Attendees

• You may only add a selfie of yourself, or of a child you are the parent or guardian of.
• When we deliver photos to you, you receive a personal, non-commercial licence to keep, view and share them. Copyright stays with the photographer or organiser; you may not sell the photos or present them as your own work.
• Where the organiser chose a watermark or branding, that is the version you receive. Do not remove or hide a watermark.
• You can delete your selfie or erase your account at any time from your account screen.

Acceptable use

Do not use Spotted to identify people you do not know, to collect other people's photos, to scrape or bulk-download content you are not entitled to, or to interfere with the service. Do not share your sign-in details. We may suspend or close accounts that break these terms.

Payments

Some events charge for downloads. If an event does, the price is shown before you pay, and the organiser's refund terms, if any, are shown with it. We do not store card details ourselves.

Availability and changes

Spotted is offered as it is, and it is still new. We work to keep it available and accurate, but we do not promise that every photo of you will be found or that the service will never be interrupted. We may change or withdraw features; where a change affects you materially we will tell you in advance where we can.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of Spotted, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act or any other law that cannot be excluded.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them.
